Summary

These terms govern the use of Incognito VPS hosting services. Accounts are token-based with no identity requirement, payment is in cryptocurrency and non-reversible, and either party may terminate with notice. Nothing here creates an obligation for you to identify yourself.

1. Who these terms are between

These terms govern your use of hosting services supplied by Incognito VPS Infrastructure OÜ (“Incognito VPS”, “we”). By deploying a server you accept them. If you do not accept them, do not deploy a server — there is nothing else you need to do, because there is no account to close.

We may update these terms. Material changes are announced on the changelog at least thirty days before they take effect, and the previous version stays available at a dated URL. Continuing to use the service after that date is acceptance.

2. Your account is a token

There is no username, no password and no email address. At checkout you receive a 20-character access token which is the sole credential for the account. Anyone holding that token controls the servers under it.

We store only an Argon2id hash of the token. We cannot recover it, reset it, or verify your identity by any other means. If you lose it, the account becomes permanently unreachable and any servers under it run until their paid term expires and are then terminated. This is a deliberate property of the design and it is not something we can make an exception for.

3. Payment

All payment is in cryptocurrency. We do not accept cards, bank transfers or any fiat instrument. Payments settle on-chain and are final — there is no chargeback mechanism, which is precisely what allows us to operate without identity verification.

Invoices carry a ninety-minute rate lock. Underpayments within 2% are accepted automatically. Overpayments and late payments are credited to your account balance in USD at the rate that applied when the payment confirmed. Balance does not expire and is spendable on anything in the catalogue.

Services renew automatically from balance where balance is sufficient. Where it is not, the service is suspended at term end and terminated after a further seven days.

4. What we provide

We provide the resources described in the plan you bought, in the jurisdiction you selected, subject to the service level agreement. We provide 99.9% monthly uptime with automatic service credits below that threshold.

We do not provide managed administration, backup of your data, or any guarantee that your workload is fit for purpose. The server is yours to run.

5. What you must not do

The acceptable use policy is incorporated into these terms by reference and forms part of them. In summary: no child sexual abuse material, no malware infrastructure, no phishing, no bulk unsolicited email, no attacks against third-party systems, and nothing criminal in the jurisdiction the server sits in.

You are responsible for the content and conduct of everything on your server, including anything placed there by a third party you granted access to.

6. Suspension and termination

We may suspend a server immediately and without notice where it is distributing child sexual abuse material, running active attack infrastructure, or where a valid legal order requires it. Every other enforcement action begins with notice to you and a response window of at least 72 hours.

You may terminate at any time from the account panel. Terminated servers are wiped on reallocation; a multi-pass overwrite is available on request at no charge.

We may terminate for repeated policy breach, for non-payment, or on thirty days’ notice for any reason. Where we terminate without cause, unused prepaid balance is refunded to an address you nominate.

7. Liability

Our aggregate liability for any claim is limited to the fees you paid us in the three months preceding the claim. We are not liable for lost profits, lost data, or consequential loss of any kind.

This is the standard limitation and we state it plainly rather than burying it. If your workload cannot tolerate that exposure, keep backups elsewhere — which you should be doing regardless of who hosts you.

8. Governing law

These terms are governed by the law of the jurisdiction in which Incognito VPS Infrastructure OÜ is established. Disputes concerning a specific server may alternatively be brought in the jurisdiction where that server is located.

Nothing in these terms limits any right you have under mandatory consumer law in your own jurisdiction.
